physicians and psychologists, must report child abuse within 48 hours
of Its discovery.
Statistically, the odds are not too good that action will result. In
Texas in 1985, no charges were filed against 44,787 alleged
perpetrators of all forms of child abuse, criminal charges were filed
against 2,607, charges were dropped for 67 of these, and convictions
were returned for 140. There were two acquittals. The figures are
from the Texas Medicine article by authors Drs. David C. Oldham
and Frank E. Crumley of Baylor University Medical Center, Drs. Joan
Hebeler and David A. Waller of the University of Texas Health
Science Center at Dallas, and Dr. Dan Myers, and Dr. John G.
Looney of Timbcrlawn Psychiatric Hospital in Dallas.
Lack of clinical knowledge and assessment skills, feelings of
disbelief, and fear of legal entanglements have all contributed to
physicians avoiding this problem, the authors say. No one likes to
speak of the unspeakable...but we must.

A GREAT DEAL has been spoken and written in
• m recent weeks about one of the Constitutional
rights of individual citizens, the right to privacy,
especially to privacy in one’s own home.
One of the major objections raised in his
confirmation hearings to Supreme Court Nominee
Judge Bork was his repeated declaration that he
could not properly read the Constitution as
recognizing a general right to privacy since no
particular provision of that document specifically
grants such a right.
That is true. It doesn’t.
What it does specify, however, is spelled out in
two of the Bill of Rights Amendments. The Ninth
Amendment declares that "the enumeration in the
Constitution of certain rights shall not be
construed to deny or disparage others retained by
the people"; and the Tenth Amendment reinforc-
es that guarantee, declaring that "the powers not
delegated to the United States by the Constitution,
nor prohibited by it to the States, arc reserved to
the States respectively, or to the people.”
If the Constitution does not specifically grant to
the people the right to privacy, neither does it
grant to the government specifically the right to
invade that privacy.
And the Fourth Amendment does specifically
provide for "the right of the people to be secure in
their persons, houses, papers and effects, against
unreasonable searches and seizures.”
The exercise of Constitutional power is a
two-edged sword...cutting both ways. Certain
rights not specifically denied to the people, or r«
specifically delegated to the government, accord-
ing to the clear language of Amendments Nine and
Ten, are reserved to the people.
Surely those rights of privacy which Judge Bork
cannot find specifically granted by the Constitution
are not specifically taken away from the people,
and so should not be arbitrarily invaded by the
government.
Former Supreme Court Justice Louis Brendeis
once addressed that specific subject, declaring that
the makers of the Constitution "conferred, as
against the government, the right to be Iqk
alone...the most comprehensive of rights and the
rights most valued by civilized men."
The Supreme Court, what’s more, has upheld
the rights of privacy in specific cases. The Court
struck down a state law in Connecticut, for
example, which banned the sale or use of
contraceptives, even for married couples.
Many of these "privacy rights" will be
controversial and unpopular with some segments
of the population, but we cannot uphold the rights
to privacy for some and not for others. The
Constitution should protect them all. equally and
equably, from invasion of privacy regardless or
sexual preferences or practices.
