L. Hamilton Trustee for Elizabeth Hamilton and

and William C. Riley the above named defen-
dants. And whereas Clinton.Terry Esquire one
of the said attorneys for the said plaintiffs did at
the time of instituting the said suit make affidavit
before the Clerk of our said Distiiet Court that
the said defendants therein Elizabeth Hamilton
William L. Hamilton Thomas L3 nch Hamilton
and James Dick Hill are non-residents of the State
of Texas thereby making it requisite that the said
defendants nou-residonts should be cited by pub-
lication according to law to answer in said suit
of which the following is a brief statement of the
cause of action therein.
Petition! .-s allege their residence in the city of
Charleston State of South Carolina ; that said
South We- ern Railroad Bank is duly chartered
by said State and doing a banking business in the
city of Charleston in said State of South Carolina;
and that said defendants Elizabeth Hamilton and
William L. Hamilton Trustee as aforesaid resi-
dents of Chatham county State of Georgia are
indebted to petitioners use aforesaid in the sum
of 1234 03-100 with interest at 7 per cent per
annum from 5th April 1S5I until paid; for that
on the 5th April ISo'i saia defendants Elizabeth
and William L. Hamilton tr"stee aforesaid in
Savannah Georgia gave a bond unto the Presi-
dent and Directors aforesaid of safd Bank in the
penal sum of 21(JS OtMu conditioned for the
payment of $123 i 03-100 on 5th April lS51;and
they refer to and attach the said bond as part of
petition
Petitioners furthetallege the failure and refusal
of the obligees to pay said debt and interest or
any part thereof.
Petitioners allege the interest of the Slate of
Georgia at the time said bond was executed and
became due to be at rate of 7 per cent. per an-
num. Petitioners allege that the payment ofsaid bond
is secured by a mortgage executed on Sth April.
1S53 by said defendant Thomas Lynch Hamilton
a3 trustee as aforesaid a resident of said Chatham
county Georgia upon the following n'gro slives
on the Retrieve Plantation in Brazoria county to-
wit: Robert engiueer aged about oO a:d Ned
sugar boiler aged about 4U ; that said mortgage
was duly authenticated and was duly recorded by
Clerk County Court Brazoria County on Sl.-t
ilay 1854 after having been filed 27 th May
1854 in said Gounty Clerk's office; and petition-
ers refer to and annex said mortgage as part of
petition and pray foreclosure of the same.
Petitioners allege that said "Retrieve Planta-
tion" upon which said mortgaged negroes are.
wason day of A. D. IS conveyed in trust
forcertain purposes to Henry R. W. iliil late of
New Orleans in Louisiana; and for particulars
they refer to a certain deed and declaration of
trust made by said Hill both recorded in the
County Clerk's office for said Brazoria county.
They allege the death of said Hill his leaving a
will admitted to probate in the proper Couit iu
Louisiana by which he left his son the sold de-
fendant James Dick Hill as his residuary legatee
and devisee. They allege that said James Dick
Hill defendant was a minor but that he has been
legally emancipated.
Petitioners further allege that said defend uit.
William C. Riley a resident of said county oflJr 1-
zoria acting as agent for said defendant Hill de-
tains unjustly said slaves from petitioners.
" They pray that each of said defendants may be
cited according to law to answer in this suit and
that judgment may ba rendered in their favor fl r
use aforesaid for full amount of said drtbr with
interest and costs against said defenr!.T.tc. Eii. 1-

as aforesaid and that judgment of foreclosure of
said mortgage be rendered naitst said Thuuia"
Lynch Hamilton and that said mortgaged slaves
be decreed to be sold in satisfaction of said judg-
ment; that said defendant Hill and Rile be
condemned to deliver up said slaves to be sold
and for general relief.
These are therefore to command you that you
summon the said defendant James Dick Hill to
be and appear either in person or by attorney
belore our Hon. Diatric: Court in and for the
county of Brazoria at the next term thereof to
be holden at the Court House in the town of Bra-
zoria in said county of Brazoria on the ninth
Monday after the first Monday in October A. D.
1851 it being the 4th day of December iu said
vear then and there to answer tne said petition
or complaint by making publication of this cita-
tion in some newspaper published in the said
county of Brazoria lor four weeks piev.ous to the
return day of this process.
Herein fail not and due return make hereof ac-
cording to law on the fust day of the Paid term
of our said Court how you have executed the
