notice that the old town of Ochil-
• tree to the wtest of us has got in
the harness again for a railroad
and this time are going to have
one. Well, that is good. The
town has needed one for some
years and have made many
efforts the same as Lipscomb, but
fell flat. Here's hoping the old
line that is proposed this time will
be a howling success as Ochiltree
has about the livest bunch of
"Live Wires" generally found fo
a town of its size. Lipscomb is yet
craving one as strong as ever and
perhaps in the course of human
events some company will feel
like shooting one down the valley
into Oklahoma City and then
there would sure enough be some-
thing doing "right close 'round
home."

for four weeks previous to the re-
turn day hereof, you Summon C.
A. Fox whose residence is un-
known, to be and appear before
the Hon. District Court, at the
jiext regular term thereof, to be
"holden in the County of Lips-
comb, at the Court House there-
of, in Lipscomb, Texas, on the
fourth Monday in April, 1917,
same being the 23rd ctoy
of said month, in a cause
wherein Cora Alice Fox is
plaintiff and the said C. A.
Fox is defendant, File Number
being 266, then and there to
answer the Petition of Cora Alice
Fox,.filed in said Court, on the
21st day of March, 1917, against
the said C. A. Fox, and alleging
in substance as follows, towit:
That on Oct. 5, 1893, plaintiff
and defendant were legally marri-
ed and that they continued to
live together as husband and wife
until about Sept. 4, 1913:
That plaintiff has been an act-
ual bona fide resident of Texas
for 12' months and of Lipscomb
County for 6 months;
That on or about Sept. 4,
1913, defendant sent plaintiff and
his children from Lamar, Colo.;
where they had been living, to
Lipscomb Co., Texas, with the
agreement that he would follow
as soon as he could settle some
business matters; that it was the
intention of defendant at that
time to abandon plaintiff, and he
did abandon her in that manner,
without her consent, fault or pro-
curement, and that the intention
to so abandon has existed contin-
uously to this time.
That four children were born of
the marriage, two of whom are
approaching maturity, the other
two being girls, 6 and 4 years old,
and that plaintiff is able and will-
ing to 'provide for and educate
said two girls, and defendant
having abandoned them and
ceased to furnish neccessaries of
life, their custody should be
awaided to plaintiff. i
Plaintiff prays for dissolution of
the marriage, for the custody of
said two girls and general relief.
Herein Fail Not, but have you
then and there before said Court
this Writ, with your return there-
on, showing how you have execut-
ed the isame.

You are hereby commanded to
summons the heirs of J. D. K.
Smith and M, C. Smith, deceas-
ed, whose names are unknown,
to appear at the next regular
term of the district court of Lip*
scomb County, to be held at the
Court House thereof in the town
of Lipscomb on the 4th Mon-
day in April, the same being the
23rd day of April, A. D. 1917,
then and there to answer a
petition filed in said Court on
the 20th day of February, A. D.
1917, in cause No. 259 wherein
Denton L. Burch is plaintiff and
the unknown heirs of J. D. K.
Smith and M. C. Smith, deceas-
ed, are defendants, the cause of
action being alleged as follows:
That in 1889 one W. F. Mill-
er excuted his three promissory
notes, payable *to the order of
M. C. Smith, each for the prin-
cipal sum of $533.00 and due in
one, two and three years, respec-
tively, from date of execution and
drawing 8 per cent interest from
date until paid, and, to secure
the payment of said notes, he
excuted and delivered to J. D. K.
Smith, as trnstee, a deed of trust
on Section No. 155, Block No.
10, Lipscomb County, Texas, and
thereafter and at the maturity
of the notes the said Miller paid
them in full; that said deed of
trust is recorded in book No. 2
page 47 of deed of trust records
of Lipscomb County, Texas, and
the same nowhere appears to
have been released of record..
Plaintiff alleges that he now
owns the East one-hals of section
No. 155, that the recorded deed
of trust, appearing unreleased of
record, constitutes a cloud on his
title and he prays foi a judgment
of the Court, clearing the title
of such cloud and-decreeing sat-
isfaction of the lien, • and for*
general relief.
You are further commanded
to serve this citation by publish-
ing the same once in each week
for eight successive weeks ^prev-
ious to the return day thereof in
a newspaper published in * your
county, but if no news paper is
published in your County,
then in the near-
est County where a news paper is
published.
