In the name and by the authority of the State of Texas - The Grand jurors for the
State of Texas only elected impaneled Texans and charged to inquire of offenses
committed in the County of Collin in the State of Texas upon their oath present that one
Walker Martin, late of the county and state aforesaid not having the fear of God before
his eyes, but being moved and seduced by the instigation of the Devil, on the first day of
February AD in the year of our Lord one thousand eight hundred and fifty-eight, with
force and arms in the county and state aforesaid and upon one P. A. T. Doggett in the
peace of God and our said state then and there being feloniously, wilfully and with malice
aforethought, did make an assault, and that the said " Walker Martin," a certain double
barreled shotgun, of the value of twenty Dollars, then and there loaded and charged with
gunpowder, and diverse lead in buckshot, which said double barreled shotgun, so loaded
and charged as aforesaid he the said Walker Martin in both his hands then, then and there
had and held at, to, against, and upon the said P. A. T. Doggett, then and there,
feloniously and wilfully and of his malice aforethought, did shoot and discharge and that
the said Walker Martin with the lead in buckshot aforesaid, out of the double barreled
shotgun aforesaid, then and there, by force of the gunpowder, shot and sent forth as
aforesaid the said P.A. T. Doggett in and upon the back, left should and neck of him the
said P. A. T Doggett then and there feloniously, wilfully and of his malice aforethought,
did strike penetrate and wound giving to the said P.A.T. Doggett, then and there, with the
lead in buckshots aforesaid, so as aforesaid that discharged and sent forth out of the
double barreled shotgun aforesaid by the said Walker Martin, in and upon the said back,
left shoulder, and neck of him the said P.A.T. Doggett twelve mortal wounds of the depth
of ten inches, and of the breadth of one inch of which said mortal wounds the said P.A.T.
Doggett then and there did instantly die. And so the jurors aforesaid upon their oath
aforesaid do say that the said Walker Martin, the said P. A. T. Doggett in manner and
form aforesaid feloniously, willully and of his malice aforethought did kill and murder,
contrary to the form of the state in such case made and provided, and against the peace
and dignity of the state of Texas
